How job reservation, reasonable accommodation and anti-discrimination rules help people with disabilities earn a living.
A steady job is the foundation of financial security. People with disabilities in India have specific legal rights designed to open up employment.
Reservation in government jobs
The RPwD Act, 2016 requires government establishments to reserve at least 4 percent of vacancies for people with benchmark disabilities, up from 3 percent under the older law. The 4 percent is split across groups of disabilities, such as blindness and low vision, deafness and hard of hearing, locomotor disability, and intellectual disability, autism and multiple disabilities.
Candidates may also get age relaxation and fee concessions in recruitment exams.
Rights at work
The Act requires:
- Non-discrimination: employers cannot discriminate on the grounds of disability.
- Reasonable accommodation: adjustments that allow a person to do the job, such as screen reader software, flexible hours or an accessible workstation.
- Protection on acquiring a disability: a government employee who acquires a disability during service cannot be dismissed or demoted; they should be moved to a suitable post with the same pay and benefits.
- Equal opportunity policies: establishments must publish a policy explaining how they will support employees with disabilities.
Private sector
Private employers are not bound by the reservation quota, but they must follow non-discrimination rules and are encouraged to hire people with disabilities. The government has offered incentives, such as paying part of the employer’s provident fund and insurance contributions for employees with disabilities for a period. Many large companies run disability hiring programmes and report on them.
Practical tips
- Mention accommodation needs when it helps; employers often find them cheaper than expected.
- Look for employers with disability hiring programmes and inclusive job portals.
- Keep records if you face discrimination; the Chief Commissioner and State Commissioners for Persons with Disabilities handle complaints.
